Terms and Conditions for the BMW M2 Giveaway

Participate and Win!

By purchasing a giveaway voucher through the official online shop of Art Hotel Baden-Baden, you have the opportunity to win a BMW M2 (Model G87, Year 2025). A total of three participation options are available.

1. Organizer

The organizer of the giveaway is

This giveaway is not affiliated with Facebook or Instagram and is in no way sponsored, endorsed, or organized by these platforms.

2. Eligibility

All natural persons who have reached the age of 18 are eligible to participate, regardless of their place of residence. Participants residing outside of Germany are solely responsible for verifying the legality of their participation under the laws of their country of residence. Participation is excluded for persons subject to sanctions under EU, German, or international regulations.

Employees of the organizer are excluded from participation.

Participation is not limited to a single entry. Multiple entries through the designated participation methods are permitted.

The participation requirements must be fulfilled within the participation period and submitted to the organizer through the designated channels.

Participation through other means, as well as entries submitted before the start or after the end of the giveaway, will not be considered.

3. Participation in the Giveaway – Three Equal Options

3.1 Participation via Invoice Upload

Participation is available for guests who stayed at Art Hotel Baden-Baden, Baldreitstraße 1, 76530 Baden-Baden, between October 27, 2025 and June 30, 2026 (inclusive). Only direct bookings are eligible (e.g., via the hotel website, inquiry, email, etc.) – bookings through third-party providers (e.g., Booking.com, AirBNB, etc.) are not eligible.

The room category booked does not matter – every overnight stay equally qualifies for participation. After check-out, guests can send their invoice by email to gewinnspiel@arthotel-baden-baden.com with the subject line "BMW Giveaway" along with their first and last name, address, email address, and phone number.

3.2 Participation via Voucher Purchase

Alternatively, participants can purchase a giveaway voucher in the Art Hotel Online Shop (www.gutscheine.arthotel-baden-baden.com). The purchase of a voucher additionally entitles participation in the giveaway.

Two voucher options are available:

€33 Discount Voucher A €33 discount voucher for one overnight stay including breakfast (from €130). The cost of the discount voucher represents direct value and therefore does not constitute a stake in the sense of gambling.

1 voucher = 1x entry in the BMW M2 giveaway = €33 discount on 1 overnight stay

3 vouchers = 3x entries in the giveaway = €99 total discount on 3 overnight stays

5 vouchers = 5x entries in the giveaway = €165 total discount on 5 overnight stays

10 vouchers = 10x entries in the giveaway = €330 total discount on 10 overnight stays

Please note: Only one €33 discount voucher can be redeemed per overnight stay.

€133 Overnight Stay Voucher An overnight stay voucher for 1 night for 2 persons including breakfast. The cost of the overnight stay voucher represents direct value and therefore does not constitute a stake in the sense of gambling.

1 voucher = 1x entry in the BMW M2 giveaway = 1 overnight stay for 2 persons incl. breakfast

2 vouchers = 2x entries in the giveaway = 2 overnight stays for 2 persons incl. breakfast

3 vouchers = 3x entries in the giveaway = 3 overnight stays for 2 persons incl. breakfast

Redemption of the €133 overnight stay voucher is by request via email or phone, as availability and seasonal pricing must be considered.

The following applies to both voucher types:

The total number of vouchers offered for sale for the raffle is limited to a maximum of 4,444 units – for all voucher types combined.

Multiple purchases allowed – More vouchers = More chances to win: You can purchase multiple vouchers and thereby increase your chances of winning.

Voucher redemption is only possible if rooms are available during the desired period. There is no entitlement to a specific room category or specific period. Reservations are made based on availability in the order of receipt.

Purchased discount vouchers are non-transferable and valid for 3 years.

Purchased overnight stay vouchers are transferable and valid for 3 years.

3.3 Participation via Opinion Form

Your opinion counts! Participants can fill out a special form at Art Hotel Baden-Baden. They can contribute ideas and suggestions on how to make the city of Baden-Baden even more attractive. As a thank you, every participant will be entered into the giveaway. Name, email address, and phone number are required for participation.

4. Right of Withdrawal

Participants who have purchased a voucher online have a statutory 14-day right of withdrawal from the day of purchase. In case of withdrawal, the purchase price will be fully refunded. The giveaway participation will also be revoked. Already redeemed vouchers are excluded from withdrawal.

5. Duration of the Giveaway

The giveaway begins on October 27, 2025 and ends on June 30, 2026.

The drawing will take place on July 19, 2026 at 4:00 PM (CET) live on the organizer's Instagram and Facebook channels.

The organizer reserves the right to extend the duration of the giveaway once if the planned total of 4,444 vouchers has not been reached by June 30, 2026. An extension will be for a maximum of eight months.

6. Prize

The prize is a BMW M2 Coupé (G 87), Model Year 2025, Skyscraper Grey metallic, Interior Leather 'Vernasca' Black/Red, with the following equipment: M Drive Professional, Adaptive M Suspension, Harman Kardon Surround System, BMW Live Cockpit Professional, M Sport Seats, and more. Power output 480 HP, combined consumption 9.7 l/100 km, CO₂ emissions 221 g/km (WLTP).

The prize is free of charge; cash payout or exchange is excluded. The vehicle will be used for promotional purposes during the giveaway phase, so a mileage of approximately 5,000–9,000 km is to be expected.

The vehicle handover will take place at Art Hotel Baden-Baden. The winner must collect the vehicle in person at this location.

The vehicle is handed over without additional guarantees or warranties, except for the existing manufacturer's warranty.

International Winners: Vehicle collection takes place exclusively at Art Hotel Baden-Baden, Germany. The winner bears all costs and responsibility for:

– Travel to collect the vehicle

– Transport/export of the vehicle to their home country

– Customs duties, import taxes, and other fees

– Required permits, license plates, and insurance

– Any vehicle modifications required for registration in their home country

There is no entitlement to shipping, alternative handover locations, or cost reimbursement.

The organizer can assist the winner in arranging transportation, but the winner is responsible for any additional fees incurred.

7. Drawing Process and Winner Notification

The winner will be determined by random number generator under notarial supervision. The drawing will be broadcast live on July 12, 2026 on the organizer's social media channels.

The winner will be notified by email and phone. If the winner does not respond within 14 days, the claim expires and a new winner will be drawn.

The announcement of the winner on social media will only be made with explicit, separate consent and in anonymized form (e.g., "Max M. from Berlin").

Each valid entry is recorded in the system with a unique identification number. The participation methods are marked as follows:

R-XXXXXX for entries via invoice upload

G-XXXXXX for entries via vouchers

F-XXXXXX for entries via the form

The drawing is conducted exclusively based on these identification numbers using a random number generator.

8. Newsletter / Consent

Subscription to the email newsletter of Balak Gastro UG is optional and voluntary. It can be revoked at any time. Participation in the giveaway is not tied to newsletter subscription.

9. Data Protection

Name, email address, and phone number are collected for participation. The data is used exclusively for conducting the giveaway and contacting the winners.

Additionally, participants can voluntarily subscribe to the newsletter of Balak Gastro UG. In this case, the provided data will also be stored and processed for sending the newsletter. Subscription is optional, does not affect winning chances, and can be revoked at any time via the unsubscribe link in each email.

After completion of the giveaway, the data of all participants who have not won and have not subscribed to the newsletter will be deleted. Data of newsletter subscribers will be stored until revocation.

10. Disclaimer and Early Termination

The organizer reserves the right to terminate or modify the giveaway prematurely for important reasons. An important reason exists in particular if proper conduct of the giveaway cannot be guaranteed for legal or technical reasons (e.g., in case of official prohibition or technical errors).

The organizer reserves the right to exclude participants from participation in case of violation of these terms and conditions or manipulation of the giveaway.

The organizer is not liable for damages caused by errors, delays, or interruptions in transmission, disruptions to technical systems and services, incorrect content, loss or deletion of data, viruses, or otherwise in connection with participation in the giveaway, unless such damages are due to gross negligence or intent on the part of the organizer.

Upon handover of the prize to the winner, responsibility and liability for further use passes entirely to the winner. The organizer assumes no liability for damages occurring after handover of the vehicle, such as accidents, improper use, or normal wear and tear.

The vehicle is handed over without additional guarantees or warranties, except for the existing manufacturer's warranty. The winner is solely responsible for ensuring that the vehicle may be legally driven or transported (e.g., by using temporary license plates, trailers, or similar solutions).

11. Tax Notice

Tax obligations may arise from the prize. International winners are additionally responsible for compliance with all tax obligations in their country of residence. It is strongly recommended to seek tax and customs advice. The winner is free to resell the vehicle at their discretion. However, participants and winners must comply with all applicable sanctions regulations of the European Union, Germany, and their country of residence.

13. Final Provisions

Legal recourse is excluded. The law of the Federal Republic of Germany applies.

14. Severability Clause

Should individual provisions of these terms and conditions be or become invalid or unenforceable, the validity of the remaining terms and conditions shall remain unaffected. In place of the invalid or unenforceable provisions, appropriate regulations shall apply that come closest to the purpose of the invalid or unenforceable provisions.
